Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Marketplace Jobs website (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

Marketplace Jobs is a job board and AI career assistant focused on marketplace and platform companies. We aggregate job postings from applicant tracking systems, provide AI-assisted search and writing tools, and allow employers to claim companies and post roles.

Eligibility and Accounts

You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate information and to update it as needed.

Candidate Use

  • We do not collect or host job applications. Applying to a role redirects you to an external employer site with its own terms and privacy practices, where you submit your application directly to the employer.
  • You are responsible for the accuracy of the information you submit to those external sites.
  • AI-generated content (summaries, matches, cover letters) is provided for guidance only and may be inaccurate. Review it before use.

Employer Use

  • When claiming a company, you represent that you are authorized to act on its behalf.
  • You are responsible for the accuracy and legality of job content you post or sync.
  • You must comply with all applicable employment and anti-discrimination laws.
  • We may remove content or revoke access for violations of these Terms.

AI Matching Tools

The Service offers AI matching tools, including Quick Match and LinkedIn Match. Quick Match asks you for preferences (role, skills, experience, location, and similar) and ranks active roles against them. LinkedIn Match asks you to submit a public LinkedIn profile URL, which we use to fetch and parse the profile's content through third-party AI providers to extract criteria such as skills, seniority, and role and then rank active roles against them.

  • By submitting a LinkedIn profile URL, you confirm that the profile is your own, is public, and that you have the right to share it. We do not access private profiles or store LinkedIn credentials.
  • The profile content is sent to our third-party AI provider for parsing and is not retained by us beyond the session. Whether the provider retains it is governed by its own terms and configuration.
  • Match results are automated suggestions for guidance only and may be inaccurate or incomplete. They are not job offers or endorsements, and we do not guarantee any application outcome.
  • We are not affiliated with, endorsed by, or sponsored by LinkedIn or any platform referenced in your profile.

AI Copilot

The AI Copilot uses third-party AI models. Output may be incorrect, incomplete, or offensive. Do not rely on it for legal, medical, financial, or professional decisions. You are responsible for reviewing and editing any AI-generated content before use.

AI Application Tool

The AI Application Tool lets you paste a job description and your own background — such as resume text or LinkedIn profile content — to generate a tailored resume, cover letter, and outreach note. This input is processed by third-party AI providers and is not retained by us beyond the session.

  • You confirm that you have the right to submit any background or resume content, including information sourced from your own LinkedIn profile or other accounts.
  • AI-generated output is provided for guidance only and may be inaccurate or incomplete. Review and edit it before sending it to any employer or contact.
  • When using generated outreach notes on platforms such as LinkedIn or by email, you must comply with those platforms' terms of service and all applicable anti-spam and messaging laws. We do not automate sending on your behalf.
  • We are not affiliated with LinkedIn or any other platform referenced in the generated content.

Third-Party Content and Links

The Service aggregates job postings from publicly available applicant tracking systems and employer sites. We pull these postings automatically and do not have a direct partnership or integration with the companies shown. We are not affiliated with, endorsed by, or sponsored by any of those companies, and all trademarks and job postings belong to their respective owners.

We do not control or endorse third-party content, and we are not liable for its accuracy, availability, or outcomes. Your interactions with third parties are solely between you and them.

Prohibited Conduct

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes.
  • Submit false, misleading, or infringing content.
  • Scrape, copy, or overload the Service or its data sources.
  • Attempt to access accounts or systems you are not authorized to use.
  • Interfere with the proper functioning of the Service.

Intellectual Property

The Service, including its design, text, and software, is owned by us and protected by intellectual property laws. Job postings remain the property of their respective employers. You may not copy, modify, or redistribute our content without permission.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that job postings are accurate, available, or current, or that applications will result in employment. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any outcomes related to job applications, employer interactions, or AI-generated content.

To the extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service, for any and all claims, shall not exceed the greater of (a) the amounts you have paid to us in the twelve months preceding the claim, or (b) USD $100. This limitation applies even if a remedy fails of its essential purpose.

Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Marketplace Jobs and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms or applicable law; (c) your violation of the rights of any third party; and (d) for employers, any job content you post, sync, or otherwise submit, including claims of discrimination, infringement, or inaccuracy. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.

Copyright and Trademark; DMCA

We respect intellectual property rights. Job postings and company trademarks displayed on the Service belong to their respective owners and are shown for informational purposes only.

If you believe that content on the Service infringes a copyright that you own or control, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated copyright agent at contact@marketplacejobs.com. Your notice must include: identification of the copyrighted work claimed to have been infringed; identification of the allegedly infringing material and its location; your contact information; a statement that you have a good-faith belief that the use is not authorized; a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner; and your physical or electronic signature. We will process and respond to valid notices in accordance with applicable law and may remove or disable access to infringing material. Providing false or misleading information may result in liability.

Termination and Suspension

We may suspend or terminate your access to the Service, and remove or disable any content you submitted, at any time and for any reason, including a violation of these Terms, without prior notice. You may stop using the Service at any time. Upon termination, all provisions of these Terms that by their nature should survive termination — including Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Arbitration — shall survive.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect and handle your information.

Arbitration and Class Action Waiver

Please read this section carefully — it affects your rights. Any dispute or claim arising out of or relating to these Terms or the Service will be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or, for employers, its Commercial Arbitration Rules) then in effect, except for matters that the AAA rules exclude from arbitration. The arbitration will be conducted in the English language before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.

You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

Either of us may bring an action in small claims court for claims within that court's jurisdiction and brought in that person's individual capacity, without first arbitrating. If for any reason a claim proceeds in court rather than arbitration, each party waives any right to a jury trial. This arbitration agreement and class action waiver do not apply to consumers in the European Union, the United Kingdom, or Switzerland to the extent it would deprive them of mandatory consumer-protection rights under the laws of their country of residence; in that case such disputes may be brought in the courts of that country.

You may opt out of this arbitration agreement by sending written notice to contact@marketplacejobs.com within 30 days of first accepting these Terms, stating your name, email, and intent to opt out. Opting out does not affect the class action waiver except where unenforceable by law.

Governing Law

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflict-of-law principles, except as expressly provided in the Arbitration section above. To the extent any claim is not subject to arbitration, it will be resolved in the state or federal courts located in California. If you are a consumer in the European Union, the United Kingdom, or Switzerland, nothing in these Terms deprives you of the mandatory consumer-protection rights granted by the laws of your country of residence, and you may bring proceedings in that country.

Severability; Entire Agreement

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Marketplace Jobs relating to the Service and supersede any prior agreements.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes indicates acceptance. Material changes affecting existing obligations will be effective as of the "Last updated" date; we may also notify you by other means where required by law.
